By accessing or using the VegAssess application and website ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

VegAssess is a vegetation quality assessment application designed for field ecologists and environmental consultants. The Service allows users to record vegetation data, compare against ecological benchmarks, generate condition scores, and produce reports.

3. User Accounts

You must create an account to use VegAssess. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service to store or transmit malicious code or harmful content.

5. Data Ownership

You retain ownership of all assessment data you create using VegAssess. We do not claim any intellectual property rights over your data. You grant us a limited licence to store, process, and transmit your data solely for the purpose of providing the Service.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. VegAssess is a tool to assist with vegetation assessments and does not constitute professional ecological advice. Users are responsible for verifying the accuracy of their assessments and ensuring compliance with relevant regulations.

7. Limitation of Liability

To the maximum extent permitted by Australian law, VegAssess shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill.

8. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or an in-app notification. Continued use of the Service after changes constitutes acceptance of the updated terms.

9. Governing Law

These terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Victoria.
